Agreement to Terms

By downloading, installing, or using any application developed by SideSwipe Labs ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our applications.

1. Use of Our Applications

1.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use our applications on Apple devices that you own or control, strictly in accordance with these Terms and any applicable Apple terms and conditions.

1.2 Restrictions

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any application.
• Modify, adapt, translate, or create derivative works based on any application.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
• Use our applications for any illegal purpose or in violation of any applicable laws.
• Attempt to circumvent any security features, encryption mechanisms, or access controls.
• Use automated systems or software to extract data from our applications.

1.3 Acceptable Use

Our applications are intended primarily for personal use, except where individual app terms permit broader use (for example, Pressbook permits personal and commercial use of the albums you create; see the Pressbook Terms of Service). You are responsible for all activity that occurs through your use of our applications. You agree to use our applications only for lawful purposes and in a manner consistent with these Terms.

2. Health and Fitness Disclaimer

2.1 Not Medical Advice

Our health and fitness applications (such as Fia) are designed for informational and educational purposes only. They are not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.

2.2 Fitness Activities

Participation in fitness activities involves inherent risks. You acknowledge that you are voluntarily participating in exercise activities suggested by our applications and assume all associated risks. Consult your physician before beginning any exercise program, particularly if you have any pre-existing health conditions.

2.3 Ayurvedic and Wellness Content

Content related to Ayurvedic practices, traditional wellness, and holistic health is provided for educational purposes. Such content is based on traditional knowledge systems and should not be interpreted as scientifically validated medical treatment. Individual results may vary.

3. Pressbook

Pressbook offers a free tier and three Pro subscription options:

• Pro Monthly: $4.99/month, auto-renewing
• Pro Yearly: $29.99/year, auto-renewing (about 50% savings vs. monthly)
• Pro Lifetime: $79.99 one-time purchase, non-consumable

Subscriptions auto-renew unless canceled at least 24 hours before the period ends, in Settings → your name → Subscriptions. Apple processes all payments. See the Pressbook Terms of Service for full subscription disclosures, refund handling, Memory Capsule terms, and the community rules you agree to before you share, join a circle, or comment.

Fia

Fia is a wellness app. It does not diagnose, treat, or prevent any condition. Your logs stay on your iPhone. Fia Plus is a monthly plan, a yearly plan, or a one-time Lifetime purchase. The price is set for each country and shown in the App Store before you buy. Family Sharing is on. There is no free trial. See the Fia Terms of Use and the Fia Privacy Policy.

4. Intellectual Property

All intellectual property rights in our applications, including but not limited to software code, design elements, graphics, icons, text, and user interface components, are owned by SideSwipe Labs or our licensors. These Terms do not grant you any right, title, or interest in our intellectual property beyond the limited license set forth in Section 1.1.

"SideSwipe Labs," "Fia," "Graycard," and "Pressbook" are trademarks of SideSwipe Labs. You may not use our trademarks without prior written consent.

5. Disclaimers and Limitation of Liability

5.1 "As Is" Basis

Our applications are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

5.2 No Guarantee

We do not guarantee that our applications will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through our applications.

5.3 Limitation of Liability

To the maximum extent permitted by applicable law, SideSwipe Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage arising from or related to your use of our applications.

6. Data and Your Device

As outlined in our Privacy Policy, what our applications create is stored on your device, unless you choose to sync or share it through iCloud. You are responsible for maintaining backups of your device and data. SideSwipe Labs is not responsible for any loss of data resulting from device failure, theft, loss, or any other cause.

If you choose to enable iCloud sync or sharing, data availability is subject to Apple's iCloud terms and service availability.

7. App Store Terms

Your use of our applications is also subject to the Apple Media Services Terms and Conditions. In the event of a conflict between these Terms and Apple's terms, Apple's terms shall prevail to the extent of the conflict. You acknowledge that Apple has no obligation to provide maintenance or support for our applications.

8. Termination

We reserve the right to terminate or suspend your access to our applications at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use our applications will immediately cease.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated revision date. Your continued use of our applications after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
